The Latest on Jeff Hardy’s Legal Issues – Court Date Set, Four Different Counts Against Hardy

TNA wrestler Jeff Hardy is scheduled for trial at the Superior Court in Moore County, N.C. on Wednesday, March 17. Also, Hardy is faced with a new charge of “conspiracy to traffic opium.”

On January 4, Hardy was indicted on drug-possession charges stemming from his September 11 arrest at his home in North Carolina.

Hardy’s legal team will present his defense against the charges at the March trial and a jury of 12 peers will render a verdict. The following is a list of the charges Hardy is faced with.

Case 1 – Felony drug trafficking, Two felony charges of possession of a Schedule III controlled substance or drug.

Case 2 – Felony possession of cocaine, Felony maintaining a dwelling for redistribution of controlled substances.

Case 3 – Misdemeanor Possession of drug paraphernalia.

Case 4 (newly added in 2010) – Conspiracy to traffic opium.

According to the statute cited, the new charge is for trafficking four or more grams, but less than fourteen grams of opium/heroin.

“N.C. Gen. Stat. § 90-95(h)(4) (2005) provides that ‘[a]nyperson who sells, manufactures, delivers, transports, or possesses four grams or more of opium or opiate, or any salt, compound, derivative, or preparation of opium or opiate’ is guilty of trafficking in opium or heroin. If a defendant does not maintain exclusive control of the place where the controlled substance is found, the State must show ‘other incriminating circumstances’ to permit the inference of constructive possession.”

    jeff hardy should not go to court because he had not enough drugs to go over the n.c. drug limit instead of going to jail he should go to rehab or have a bond……

    i think that jeff hardy is a role model to many!!!!He is my hero and i love him to death i would do anything in the world to meet him!!!!he should just be put in rehab and then come bacl to the wwe!!!!He will and is MISSED AND NEEDS TO RETURNS!

    wow what a piece of crap! how many chances has the wwe givin jeff hardy and he still always messes it up he was fired of failing drug test, then they take him back after his stint in TNA and they give him the WWE Title. so here comes TNA for jeff hardy have a lovely career in a terrible wrestling business and if anyone likes this crap congrats u can have this piece of crap back in TNA

    I have been a fan of Jeff since O.M.E.G.A. and I absolutely admire him and his courage to have his life plastered out there for the world to see and judge. For those who say he is a role model he shouldn’t be. Why should someone you do not know, probably never will and having a career in a sport where it’s more likely to become a professional football player than a professional wrestler. His JOB is to wrestle. His JOB is not to maintain his life in any other way than what JEFF wants to. You want a role model? Look to YOUR Family or friends or community leaders, not to a man who just wants to fulfill HIS lifelong dream, which may i add he did do. It is not his JOB to do anything for anyone but himself, and for people that don’t agree with that, well do not watch him, do not support him and do not purchase merchandise supporting him, thats YOUR choice. There are millions of people that will, I being one of them.

    Jeff hardy is a druggie and needs to go to jail. There are millions who could benefit from rehab and now rehab has become a haven and summer campe for wealthy repeat offenders!

    For all you “Jeff Hardy lovers”, im sorry, but Jeff Hardy needs to go to jail. It will benefit not only him but his fans too. Clearly rehab isnt helping so he deserves to go to jail, maybe not for like 10 years, but not for like a month like Lindsay Lohan.
